TEAS’ TEA “Go Green. Good Luck!” Instant Win Game & Sweepstakes 1. No Purchase Necessary to enter or win. A purchase will not increase your chances of winning. The Teas’ Tea “Go Green Good Luck!” Instant Win Game & Sweepstakes begins at 12:00:01 AM ET 5/23/08 and ends at 11:59:59 PM ET 9/1/08. 2. HOW TO PLAY: Go to www.teastea.com/win anytime during the Promotion Period, and click on the Instant Win Game “Enter Now” button. Complete the registration page including your name, address, city, state, zip, daytime phone number and email. Enter this information in the space provided and click “submit”. This will automatically enter you into the random drawing for the Grand Prize and let you play the instant win game (the “Game”). To play the Game, locate the UPC code number on any Teas’ Tea bottle and enter it into the code field provided. The UPC code will be available on the side of any Teas’ Tea product or, for free at www.teastea.com/win during the Promotional Period. The time of day when you play the Game determines if you are an instant winner. If your Game play is the first to occur on or after a winning Game play time, you win prize indicated, subject to verification. If you win, you will be told online how to claim your prize. All instant win prizes must be claimed by 9/10/08. Limit one instant win Game play per user name per day. A day is defined 12:00:00 am EST – 11:59:59 pm EST. Each time you play the Game, you will automatically be entered into the Grand Prize Sweepstakes/Second Chance Drawing. Use of any automated entry software is prohibited. Prizes and Odds of Winning: Sweepstakes Prize: (1) One Grand Prize: a 2008 Toyota Prius (base model). ARV: $28,000. Winner must take delivery of the vehicle within 90 days of notice of availability from Sponsor-selected dealer near winner’s residence and will be responsible for sales tax, registration, license, title, delivery and insurance fees and cost of any available optional equipment not provided with vehicle. Winner must have valid U.S. driver’s license and proof of insurance to take delivery. Vehicle awarded may differ from any vehicle shown in promotional materials. Vehicle color, trim level, options and equipment will be determined by Sponsor in its sole discretion. Odds of winning the Grand Prize depend upon the number of eligible entries received. Odds based upon an estimate of 950,000 total game plays transacted over the Promotion Period; actual odds of winning will depend upon the number of game plays transacted. Only unclaimed instant win First Prizes will be awarded in a second chance drawing. Unclaimed Second prizes will not be awarded. Total ARV of all prizes offered during the Promotion: $58,489.50. 4. Grand Prize Sweepstakes/Second Chance Drawing: On or about 9/15/08, from all eligible entries received, a random drawing will be conducted to award the Grand Prize and any unclaimed Instant Win prizes (Second Chance Drawing). The estimated odds of winning are dependent upon the actual number of entries received and the actual number of unclaimed instant win prizes. The instant win game and sweepstakes drawing is conducted under the supervision of Marden-Kane, Inc., an independent judging organization whose decisions are final in all matters relating to this Promotion. 5. Instant Win Prize Notifications & Claims: All Game winners will receive immediate notification online after they play the Game and are sent a winning message. Winners will be asked to confirm their name and shipping address online. Prizes will be shipped to the address indicated on the prize verification form within 6 to 8 weeks after completed verification is received. To claim the Grand Prize winner will be notified by phone, e-mail and/or by overnight courier, and will be required to complete, sign and return an Affidavit of Eligibility and Liability Release and, where legal, Publicity Release. To claim the First Prize the winner will be asked to complete their on line verification as stated above, but will also be required to print out their winning notification, and send via U.S. mail to the address or fax to the number provided on their notification. A copy of the online prize notification received by Administrator, without a signature will not be valid to claim the First Prize; therefore, said prize will be forfeited and not awarded. Completed documents must be returned within 7 days after issuance of prize notification or the prize will be forfeited and awarded in the second chance drawing. If any letter/e-mail notification is returned as undeliverable, the prize will be forfeited and awarded to an alternate winner in the second chance drawing. All instant win prize claims must be received by 9/10/08. 6. Second Chance Prize Notifications: Grand Prize winner will be notified by mail, e-mail phone and/or by overnight courier, and will be required to complete, sign and return an Affidavit of Eligibility and Liability Release and, where legal, Publicity Release. Completed documents must be returned within 10 days after issuance of prize notification or the prize will be forfeited and awarded to an alternate winner. Second Chance sweepstakes winners will be notified by U.S. mail and/or e-mail. If the any First prizes are a part of the Second Chance Drawing winners will be required to complete, sign and return an Affidavit of Eligibility and Liability Release and, where legal, Publicity Release. Completed documents must be returned within 10 days after issuance of prize notification or the prize will be forfeited and awarded to an alternate winner. If any letter/e-mail notification is returned as undeliverable, the prize will be forfeited and awarded to an alternate winner, within an amount of time deemed reasonable by Sponsor. 7. Prize Restrictions: Limit one instant win prize per user name/person per week. Prizes are non-transferable, no substitutions or cash equivalents allowed, except at the discretion of the Sponsor. Taxes, and all other expenses not specified herein, if any, are the responsibility of the winner. By entering, entrants agree to be bound by these rules, and consent to use of their names and/or photographs for advertising or publicity purposes without further consideration, except where prohibited by law. Winners release Sponsor, Administrator and their respective employees, directors, officers and agents, and subsidiary, related, and affiliated companies from any and all claims or liability in connection with participation in this promotion, or acceptance or use or non-use of any prize. No more than the listed number of prizes will be awarded. In the event of an error, or for any other reason, the number of winning Game play notifications for any instant win prize level exceeds the number of instant win prizes listed for that prize level; Sponsor reserves the right to conduct a random drawing from among eligible prize claims received to award the listed number of prizes. 8. Internet: If for any reason this Promotion is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Sponsor reserves the right in its sole discretion to cancel, terminate, modify or suspend the Promotion in whole or in part, at any time, without notice and award the prizes using all non-suspect eligible entries received as of this termination date. Sponsor also reserves the right to disqualify any individual who is suspected of tampering with the entry process. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsor is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, printing, typographical or other human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to entrants or any other person’s computer relating to or resulting from participation in this Promotion or downloading any materials in relating to this Promotion. Sponsor has contracted Marden-Kane, an independent third party sweepstakes administrator. Disputes: Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the participant and Sponsor in connection with this promotion, shall be governed by, and construed in accordance with, the laws of New York, without giving effect to any choice of law or conflict of law rules (whether of New York, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than in New York. 12.
